Pending Case: Subdivision Problem During Building Permission – Akola
How it started:
One of my clients recently bought a residential plot in Akola. The plot was actually a part of a bigger plot, but the original owner never applied for official subdivision at the municipal office. The neighboring half already has a constructed house, and everything looked fine at first.
Before preparing the building permission file, I had already informed the owner clearly that we may face issues if the subdivision was not done earlier. I suggested checking and applying for it in advance. But at that time, they assumed things would go smoothly since the other half was already built.
So when I submitted the file to Akola Municipal Corporation, the problem that I had warned about actually came up.
What the corporation asked:
While checking the documents, the officers at AMC asked us to submit:
- Subdivision Order
- Approved Subdivision Layout
But we didn’t have either of these, because the previous owner had sold both parts of the original plot without getting it officially subdivided.
Why the case got stuck:
To get the plot legally subdivided now, we have to apply for it. But the rule is — both plot owners (my client and the neighbor) have to apply jointly and submit their documents.
Unfortunately, the other plot owner is not interested. His house is already constructed, and he doesn’t want to share papers or attend any meetings. Without his cooperation, we can’t complete the subdivision process.
Lessons from this case:
- Never buy part of a plot unless it’s officially subdivided.
- Before buying, ask for subdivision order and approved layout map.
- Don’t rely only on sale deed and 7/12 extract — check if the plot is shown separately in town planning records.
- Even if the other part is built up, it doesn’t mean you won’t face legal problems.
- Subdivision requires both owners’ cooperation — which isn’t always easy to get.

- Visit the Town Planning office at Akola Municipal Corporation and confirm plot status.
- Ask a local civil engineer to verify all documents before finalizing.
- If it's a part of a bigger plot, double-check if proper layout approval and mutation are done.
